Xiaomi has been rejected

The Beijing Intellectual Property Court considers Xiaomi to lack facts and legal basis for the reasons for the lawsuit, and rejected its claims.

The Tianyancha APP shows that Xiaomi Company complained that the trademark "Tianxing Financial Insurance" (advertising sales) and the quoted trademark "Star Qi Sky", "Star Overseas Sea" and "Tianxing Zhilian" are obvious in the overall appearance, calling, and meaning. It does not constitute similar, the trademark of "Tianxing Zhilian" and "Tianxing Youcou" is unstable. Therefore, the court asked the court to revoke the decision of the "Star Financial Insurance" trademark and order the Intellectual Property Office to re -make a decision.

The Beijing Intellectual Property Court believes that the main identification part of the trademark of the dispute is "star", which is the same as the main identification part of the quoting trademark. At the same time, the services such as "advertising and personnel management consulting" that they are designated are similar to similar services. Until the trial of this case, the trademark "Tianxing Zhilian" and "Tianxing Youcou" were still effective in the first trademark.
