Interpretation 丨 The Interpretation of the Ministry of Transportation on Amending the Safety Management Rules of the People's Republic of China "

Recently, the Ministry of Transport announced the "Decision on Modifying the Safety Management Rules of the People's Republic of China" (Decision of the Ministry of Transportation Order No. 20 2022), which will be implemented from the date of announcement. In order to facilitate relevant units and the public to better understand the relevant content and do a good job of implementing the work, the interpretation is as follows:

1. Amend the necessity

The "Rules of the Safety Management of High -speed passenger ships of the People's Republic of China" (hereinafter referred to as the "Rules") was formulated in 2006. It was amended in 2017, mainly to systematically standardize the safety of high -speed passenger ships from the aspects of shipping companies, ships, and crew. In order to continue to deepen the reform of "decentralization of management service", further optimize the business environment, and ensure the safe operation of high -speed passenger ships and the safety of the masses, the Rules need to be revised.

2. Revised the main content

(1) Cancellation of the "high -speed passenger ship operation safety certificate" issuance matters, adding record management and safety commitments to high -speed passenger ships. The first is to stipulate that for high -speed passenger ships that are intended to be put into operation, the shipping company shall record from the maritime management agency within 7 days of obtaining a ship's national registration certificate to facilitate the timely grasp of relevant information by maritime management institutions and strengthen safety supervision. The second is to stipulate that the shipping company prepares a safe operation commitment, and changes the enterprise from "passive supervision" to "actively act" to consolidate the main responsibility of the enterprise's main body. Third, marine management agencies should announce the list of high -speed passenger ships and related information to the society to give full play to the role of social supervision.

(2) Strengthen the safety management of high -speed passenger ships, clarify that maritime management agencies should regularly announce the docks that meet the conditions stipulated in the Rules, urge high -speed passenger vessels to peride at the eligible docks, and implement various safety management measures.

(3) According to the reality of management, the report system of the "Rules" on the occurrence of high -speed passenger ships is optimized and adjusted.

In addition, the Maritime Affairs Bureau issued the "Notice on Implementing the Safety Management Rules of High -speed Tourism", which comprehensively refine and clearly clarify specific requirements for post -event supervision.
