The Ministry of Transport decided to make the following modifications on the "Rules for Safety Management of High -speed passenger ships of the People's Republic of China" (the Ministry of Transportation Order No. 17):

1. Modify Article 4: "Ship companies operating high -speed passenger ships shall obtain corresponding business qualifications according to law."

2. Modify Article 6: "Before the starting operation of a high -speed passenger ship, the following information should be prepared:

(1) Route running manual;

(2) Ship operation manual;

(3) Ship maintenance and maintenance manual;

(4) Training manual;

(5) Safety operation commitment.

The content of the above manuals should be determined by the competent authority. Safety operation commitments should include information on ship names, ship owners, operators or managers, operating waters or routes, etc., and promise to operate safely in accordance with the law.

The shipping company shall record the high -speed passenger ships intended to be put into operation within 7 days of obtaining a ship's national registration certificate, and will record the maritime management agency of the main operating place, and attach the materials listed in the first paragraph of this article. "

3. Add one to Article 7: "After the maritime management agency receives high -speed passenger ship filing materials, if the material is complete and meets the requirements, it shall announce the list of high -speed passenger ships and related information to the society and update it in a timely manner to facilitate social inquiry And supervision.

Chapter 1 General Principles

Article 1 In order to strengthen the safety supervision and management of high -speed passenger ships, maintain the order of water traffic, and ensure the safety of human property, in accordance with the "People's Republic of China Maritime Traffic Safety Law" and "Regulations on the Safety Management of the People's Republic of China" and other relevant laws and administrative regulations , Develop this rule.

Article 2 These rules are applicable to high -speed passenger ships and ship owners, operators and related personnel who voyage, mooring and engaging in related activities in the people's Republic of China.

Article 3 The Maritime Affairs Bureau of the People's Republic of China is the competent authority to implement this rule.

Each maritime management agency is responsible for the implementation of this rule within its jurisdiction.

Chapter 2 Shipping Company

Article 4 Ship companies operating high -speed passenger ships shall obtain corresponding business qualifications in accordance with the law.

Chapter 4

Article 13 The crew members who work on a high -speed passenger ship shall meet the following requirements:

(1) Basic safety training approved by the competent authority and obtain a qualified certificate of training. Among them, the captain, driver, the head of the turbine, the motorcycle, and ordinary crew members who are designated as a safety operation and passenger safety responsibilities must also be recognized by the competent authority. (2) Captain, driver, chief, and motorcycle personnel hold a corresponding position certificate in accordance with regulations.

(3) Those who have obtained the post of high -speed passenger boat crew members will be appointed, and the trainee flight time is not less than 10 hours and 20 single voyages before the official office.

(4) The age of male captains and drivers is not more than 60 years old.

The crew members who worked on non -high -speed passenger ships applied for a high -speed passenger ship captain, a large deputy, and the chief of the wheel.

(5) The health status of the captain and driver, especially the ability of vision, hearing, and speaking, should meet the corresponding requirements.

Article 14 The maritime management agencies authorized by the competent authority are responsible for the training management and examination and certificate issuance of high -speed passenger boat crew members. Regulations on training, examinations, and certificates shall be promulgated and implemented by the competent authority.

Article 15 High -speed passenger ship shall apply for the minimum security supporting staff certificate to maritime management agencies applying for ship registration procedures. The minimum standards of high -speed passenger ships shall meet the requirements of this rule.

Article 16 The driver of a high -speed passenger ship must not have more than two hours of duty time. There should be sufficient interval breaks between the two driving duty, and it is determined by the local maritime management agency.

Chapter 5 Navigation Safe

Article 17 When sailing for high -speed passenger ships, safety speed should be used to prevent collision and wave loss. When high -speed passenger ships enter and exit ports and special voyage sections, they shall abide by the local maritime management agencies related to speed regulations.

When a high -speed passenger ship is sailing, a yellow flash must be displayed.

Article 18 When a high -speed passenger ship is sailing, the crew on duty must do a good job of safe sailing in accordance with their duties in strict accordance with their responsibilities. The person who is responsible for the driver's desk must maintain a regular hoper. Unrelated personnel are prohibited from entering the driver's desk.

Article 19 When a high -speed passenger ship sailing in the port and the inland river, it shall take the initiative to let all non -high -speed ships be allowed. When a high -speed passenger ship is avoided between maritime sailing and high -speed passenger ships and other high -speed ships, measures should be taken in accordance with the provisions of the bumps. When a high -speed passenger ship sailing in a special navigation section, it shall abide by the special navigation regulations announced by the maritime management agency.

Article 20 The maritime management agency believes that it can be recommended or specified for high -speed passenger ships if necessary. High -speed passenger ships must abide by the regulations of the maritime management agencies.

Article 21 When there is severe weather or poor visibility, maritime management agencies may recommend high -speed passenger ships to suspend shipment.

Article 22 The high -speed passenger ship shall carry the passenger in accordance with the prescribed passengers and prohibit overload. High -speed passenger ships are prohibited from unspeakable stations and passengers.

Chapter 6 Security Security

Article 23 The high -speed passenger ship shall depend on the docks that meet the following conditions:

(1) The basic requirements of safe and diving of ships;

(2) High -speed passenger ships are not easy to cause wave damage to his ship when moving;

(3) Avoid ports and stenosis in port navigation and stenosis;

(4) Passenger facilities up and down meet the safety conditions;

(5) There are enough lighting at night;

Article 24 The maritime management agency shall regularly announce the docks that meet the above conditions, urge high -speed passenger vessels to peride at the eligible docks and implement various security management measures.

Article 25 High -speed passenger ships shall have a scale and quantity restriction on the number of items for passengers, and the luggage items of passengers shall not block the channel. It is strictly forbidden to carry high -speed passenger ships or passengers carry dangerous items.

Article 26 High -speed passenger ships shall conduct emergency fire exercises and emergency evacuation exercises once a week, and do a good job of exercise. Before starting sailing, it shall explain to the passengers to the relevant safety notice.

Article 27 High -speed passenger ships shall establish a safe self -inspection system before sailing, formulate safety self -inspection forms before sailing and conduct control inspections. Maritime management agencies may supervise and random inspections of safe self -examination before sailing.

Article 28 The high -speed passenger ship shall go through the procedures for entering and leaving the port in accordance with regulations. Domestic high -speed passenger ships should go through the procedures for entering and exiting the port in accordance with regulations. International sailing high -speed passenger ships can apply for regular entry and exit permits of no more than 7 days.

High -speed passenger ships must not be available at night. However, if high -speed passenger ships in special waters need night pass, they should apply to the local maritime management agency for ships to enter and exit ports for ships. Article 29 High -speed passenger ships and personnel shall take measures to actively rescue themselves, and immediately report to the nearby water search and rescue center.

Chapter 7 Legal Responsibility

Article 30: Those who violate these rules shall be punished by the maritime management agency in accordance with relevant laws, administrative regulations, and the relevant provisions of the Ministry of Transport.

Article 31 If a high -speed passenger ship is still punished by the maritime management agency that is not corrected by the maritime management agency, the maritime management agency may order it to suspend.

Article 32 The staff of maritime management agencies violate regulations, abuse their powers, neglect their duties, and cause losses to the people's lives and property shall be given administrative sanctions shall be given by the unit or superior authority; if a crime is constituted, it will investigate its criminal responsibility in accordance with the law.

Chapter 8 Attachment

Article 33 The "high -speed passenger ship" described in these rules refers to a ship with a maximum speed (meter/second) that is equal to or greater than the following values: 3.7 ▽ 0.1667.
