Recently, Baiyun District made a judgment on a case of illegal operational hazardous chemicals. The three involved were sentenced to punishment for dangerous operations. Two of them were sentenced to seven months in prison and one person was sentenced to eight months in prison. It is reported that the case is the "Amendment to the People's Republic of China (11)" and the "Safety Production Law of the People's Republic of China" (Amended in 2021), and the first crime of crime in the field of safety in production in Guangzhou, which has been sentenced to punishment for punishment for crimes of dangerous operations case.
It is understood that the case dates back to September last year. The Baiyun District Emergency Administration received a report from the masses that there was a flowing black refueling point near the Jiahe Wanggang subway entrance of Baiyun District. Because the location involved is near the daily average passenger flow of more than 300,000 people, the Jiahe Wanggang subway station, and there are 220,000 volt high -voltage tower nearby. The location is sensitive and has a high safety risk. The bureau immediately organized personnel to investigate and deal with the flowing black refueling point.
After multiple rounds of inspection and obtaining certificate, on September 26 last year, law enforcement officers of the Baiyun District Emergency Administration, together with the public security department, accurately crack down on illegal fueling behavior involved. Two personnel, seized about 400 liters of gasoline, one van, one oil tank, and a set of tankers and related equipment.
According to the provisions of Article 134 of the Criminal Law of the People's Republic of China, the person involved has not obtained the crime of hazardous operations of hazardous chemical business licenses and illegal sale of gasoline. It stipulates that the bureau transferred the case to the public security department to investigate the corresponding criminal responsibility. In November last year, another person in the case returned.
On March 28 this year, the case was sentenced after the trial of the People's Court of Baiyun District, and the three defendants were sentenced to eight months, seven months, and seven months in prison for dangerous operations. Four and 0.28 tons of gasoline confiscated items. After the sentence, none of the defendants appealed. At present, the judgment has taken effect, and the three have been serving the sentence.
It is reported that since this year, the Baiyun District Emergency Administration has actively strengthened communication and docking with the public security departments, procuratorates, and court units, adopted a variety of effective measures to do a good job of the "Criminal Law Amendment of the People's Republic of China (11)" and "People's Republic of China." The promotion and implementation of the Safety Production Law (Amended in 2021) has promoted the improvement of the work mechanism of administrative law enforcement and criminal judicial connection, and achieved significant results in combating illegal and criminal behavior in the field of safety in production. Up to now, 5 cases of punishment for production safety, 83.3 tons of dangerous items, 5 vehicles involved in the case, and 5 people involved in the case.
