According to Article 1165 of the Civil Code: If the perpetrator causes damage to the civil rights and interests of others by fault, he shall bear the liability for infringement. Based on this, the tenants upstairs need to bear the liability for infringement compensation to Ms. Yang.
Zhao Shan Shan said that if the house is in the engineering warranty period, due to the quality of the project, Ms. Yang's house leaks, and the tenants and Ms. Yang can require developers to bear the liability for compensation. If the property is disrepairing or not fulfilling the responsibility of the sharing pipeline in the water pipeline, which leaks the water from the upstairs, the tenant and Ms. Yang may require the property to bear the liability for compensation. Regardless of whether the developer or property has the responsibility, Ms. Yang can ask the tenants to compensate the losses. After the tenants compensation, the tenants have the right to recover from the developer or the property.
In this regard, Zhao Liangshan suggested that the three parties of the property, the tenants and Ms. Yang can jointly entrust a professional appraisal agency to identify the reasons for leakage. At the same time, the property, the upstairs tenants, and Ms. Yang try to resolve compensation as much as possible.
