Article 3 The passenger taxi industry shall follow the principles of overall management, operating in accordance with the law, fair competition, and facilitating the public.

The Municipal People's Government should incorporate the passenger taxi industry into the development plan of the comprehensive transportation system, prioritize the development of public transportation, moderately develop passenger taxi, and optimize the city's transportation structure; coordinate the development scale of cruise cars and online car rental, promote industry integration, maintain fair competition Market order.

Chapter 2 Business License

Article 8 If you are engaged in the operation of passenger taxi, you shall go through business registration procedures and obtain business permits according to law.

Article 9 Anyone who apply for a parade vehicle business permit shall apply to the administrative examination and approval authority after obtaining the operating rights of the cruise vehicle and vehicle in accordance with the law, and meet the following conditions:

(1) Have the qualifications of corporate legal person;

(2) Vehicles that meet the requirements of the prescribed conditions or provide a book commitment letter;

(3) Drivers who meet the prescribed conditions;

(4) Operating funds, venues, facilities and equipment that meet the requirements of the prescribed conditions;

(5) There are sound operation management, safety production and service quality guarantee;

(6) Other conditions stipulated in laws, regulations and regulations.

The administrative examination and approval authority shall make a decision to make a license or no license within seven days from the date of receipt of the application. If a license decision is made, a parade license is issued to stipulate the operating area.

Article 10 The competent transportation department shall use the content of service quality, service quality commitment, etc. as the bidding conditions, allocate the operating rights of cruise vehicles through bidding, sign a business agreement with the Chinese bidder, and issue a certificate of operating rights of cruise vehicle vehicles. Article 11 If you apply for a license for the operation of the online car, the application shall be submitted to the administrative examination and approval authority, and the following conditions shall be met:

Article 12 Vehicles engaged in passenger taxis shall meet the following conditions:

Article 13 The qualification to apply for a passenger taxi driver shall submit an application to the competent transportation department and meet the following conditions:

For qualified, the competent transportation department shall issue a passenger taxi driver qualification certificate within seven days from the date of receipt of the application. Article 14 If the operating right of a cruise vehicle vehicle is intended to continue to engage in operation, the cruise car operator shall apply to the competent transportation department of transportation before the expiry of the validity period. Article 16 If an online car operator has one of the following circumstances, it shall order rectification within a time limit; if the overdue or unqualified rectification shall be revoked by the competent transportation department of transportation:

(1) After obtaining the operating permit, there are no legitimate reasons for more than 180 days that do not invest in vehicle operations that meet the requirements, or have no proper reasons after operation for more than 180 days.

(2) If major service quality problems, major safety production liability accidents, serious illegal business behavior or unqualified service quality and reputation assessment;

(3) Other circumstances stipulated in laws and regulations.

Article 17 If a taxi driver has one of the following circumstances, the traffic qualification certificate shall be revoked by the competent department of transportation:

(1) The physical health and age of the holder will no longer meet the requirements of the employment requirements and do not take the initiative to apply for the qualification certificate of the industry;

(2) There are violent criminal records, crimes of traffic accidents, records of dangerous driving crimes, records of drug use, and driving records after drinking;

(3) The recent three consecutive scoring cycles have recorded twelve points.

Article 18 The passenger taxi operator shall not suspend or terminate the operation without authorization. If it is necessary to suspend or terminate the operation, the application shall be submitted to the competent transportation authority of the transportation in advance, and the relevant procedures shall be completed in accordance with the law after consent.

Chapter 3 Business Services

Article 22 The passenger taxi operator shall operate in accordance with the law, be honest and trustworthy, fair competition, standardize services, and abide by the following provisions:

(3) Sign a labor contract or operating contract with the driver in accordance with the law to clarify the rights and obligations of both parties;

(4) Regularly organize drivers to participate in relevant laws and regulations, safety operations, service specifications, professional ethics, public security precautions, equipment use, etc.

(5) Ensure that the vehicle meets the safety technical conditions, the vehicle is good, the car is neat, and the special facilities and various logo logos are complete.

(6) Real -time, accurate, and complete transmission of vehicle operation information to the transportation supervision platform and the supervision platform of public security organs;

Article 23 The operator of the online car rental shall bear the responsibility of the carrier. In addition to complying with the provisions of Article 22 of these regulations, the following provisions shall also abide by the following provisions:

(2) Publicly taxing method, and report to the competent price department and transportation in advance

(5) Do not provide information docking to carry out online car management services to vehicles and drivers who do not meet the requirements;

(6) Do not crowd out competitors or monopolized markets, disrupt the normal order of the market at lower costs;

(7) Other requirements stipulated in laws, regulations and regulations.

Article 24 The third -party network aggregation platform that provides information intermediaries and passengers with information intermediaries and transaction matching services shall comply with legal and commercial ethics, and participate in market competition fairly to ensure network security and stable operation.

The online car operator can enter the aggregation platform after obtaining the business permit. The aggregation platform shall review the access to the online car ride -hailing, and those who have not obtained business permits shall not access it.

Article 25 Passenger taxi drivers shall be civilized and service specifications for passenger taxi and taxis services, and abide by the following provisions:

(1) Vehicle operating facilities and vehicle equipment shall not engage in operating activities when damage or failure;

(2) The passenger taxi shall not be handed over to the passenger -free taxi driver's employment qualification certificate or unregistered personnel;

(3) Place or display the passenger taxi driver's employment qualification certificate, road transportation certificate or online car transportation certificate at the prescribed position in the car;

(4) Provide passenger taxi operation services at the agreed time and place;

(5) Do not bypass according to the route, reasonable route or platform planning required by passengers;

(6) No one can be included without the permission of passengers;

(7) Keeping the car with a clean and clean car, the hygiene in the car is good;

(8) Use audio, air conditioning and other service equipment according to the wishes of passengers;

(9) Provide the necessary ride services for passengers who need help;

(10) It should be returned or submitted to the public security organs and the business enterprises where the items lost on the operating vehicle;

(3) On the road where parking is prohibited;

(6) Patients with drunk or mental illness lost their self -control and are not accompanied by;

Article 28 If a passenger taxi driver has one of the following circumstances, passengers have the right to refuse to pay the fare:

(1) Also unreasonable to others without passengers;

(2) The vehicle fails and cannot complete the transportation service;

(3) Pirlake car drivers do not use the device in accordance with the prescribed;

(4) The cruise car driver refused to issue a fee invoice;

(5) Online car vehicles and drivers who provide services are inconsistent online and offline.

Article 29 Any unit or individual shall use a cruise vehicle on the maneuvering vehicle or setting up a cruise vehicle special facilities such as a cruise vehicle or setting up the patrol vehicle on the cruise vehicle without authorization.

When the cruise vehicle exits the operation, the cruise car operator shall change the body color and remove the operating logo and dedicated facilities.

Article 30 Individual industrial and commercial households of cruise vehicles may sign an agreement with the service agency to accept their services and management. The service agency shall accept the guidance and supervision of the competent transportation department, establish and improve the management service system, and provide high -quality services for individual industrial and commercial households in cruise cars.

Article 33 The competent transportation department of transportation, together with the traffic management department of the public security organs, shall reasonably set up logo, standard lines and parking spaces near the proper region of public service facilities such as primary and secondary roads, public toilets, large shopping malls, etc., allowing passenger taxi to temporarily stop.

Article 34 The competent department of transportation shall establish and improve the complaint report acceptance system, public complaint reporting methods, and timely accept complaints and reports.

Article 44 In the implementation of supervision and inspection, the competent transportation department of transportation is engaged in passenger taxi operations without road transportation or online car transportation permits. Article 45 The competent department of transportation shall be supervised and inspected strictly in accordance with statutory authority and procedures. For passenger taxi operators who have obtained permission in accordance with the law, if they find that they no longer have the permit conditions, they shall be informed that the relevant authorities shall revoke its license.

Chapter 6 Legal Responsibility

Article 46 If laws and regulations have stipulated legal responsibilities in violation of the provisions of these regulations, if the laws and regulations do not stipulate the legal responsibilities, the law shall be implemented in accordance with the provisions of these regulations.

Article 47 If there is one of the following acts in violation of the provisions of these regulations, the competent department of transportation shall order to stop illegal acts and impose a fine of 10,000 yuan to 30,000 yuan:

(1) Those who have not obtained a parade operating license to engage in cruise vehicle business services;

(2) Those who have not obtained the license of online car rental operations are engaged in online car management services;

(3) The ride -hailing platform that has not obtained a business permit for the aggregation platform.

Article 48 If there is one of the following acts in violation of the provisions of these regulations, the competent department of transportation shall order to stop illegal acts, and a fine of more than 10,000 yuan or less than 10,000 yuan for each violation of the law shall be ordered. , Fined fines of 10,000 yuan or less; if the rectification is unqualified, the business license is revoked:

(1) Passenger taxi operators hand over the passenger taxi or send orders to those who have not obtained the qualification certificate of the passenger taxi.

(2) Passenger taxi operators use vehicles without road transportation or online car transportation permit for operations;

(3) The starting point is not engaged in taxi business activities in the operating area of ​​the license;

(4) The actual service vehicles, drivers and drivers who provide services are inconsistent with online reservation vehicles and drivers;

(5) The operators of online car rental have not transmitted vehicle operation information to the transportation supervision platform and the supervision platform of public security organs in accordance with the regulations.

Article 49 In violation of the provisions of these regulations, if the passenger taxi operator has one of the following behaviors, the competent transportation department shall order correction and punish a fine of more than 10,000 yuan or less:

(1) Suspension and termination of all or some passenger taxis operations without authorization;

(2) Rent or transfer taxi vehicle management rights;

(3) Those who fail to implement the complaint acceptance system in accordance with regulations;

(4) Those who fail to conduct regular hygiene, prevent and disinfect in accordance with regulations, and do not regularly organize drivers for health checks.

If the first and second behaviors listed in this Article are serious, the operating license shall be revoked by the competent department of transportation.

Article 50 Violation of the provisions of these regulations, those who have one of the following behaviors of online car rental shall be ordered to make corrections shall be ordered by the competent department of transportation to make a fine of more than 10,000 yuan or less of illegal acts; if the circumstances are serious Fined fines above 30,000 yuan:

Article 51 If there is one of the following acts in violation of the provisions of these regulations, the competent department of transportation shall be ordered to make corrections and confiscate the special facility of passenger taxi and taxis.

(1) Use a cruise vehicle on the maneuvering vehicle or setting up lights, projects and pricing equipment, empty cars and other special facilities on the maneuver vehicle outside the cruise vehicle;

(2) After the cruise vehicle exits the operation, it does not change the color of the body, demolished the operating logo and dedicated facilities.

Article 52 In violation of the provisions of these regulations, if the passenger taxi driver has one of the following circumstances, the competent department of transportation shall order correction and impose a fine of more than 500 yuan to 500 yuan:

(1) Refusing to carry passengers, dump the passenger on the way, or deliberately detour;

(2) Those who do not provide appointment services in accordance with the promise without justified reasons;

(3) Forcibly carrying other personnel without the consent of the passenger;

(4) Those who fail to issue the invoice shall not be issued in accordance with the regulations;

(5) Those who fail to use the device in accordance with the regulations;

(6) Those who fail to use audio, air conditioning and other service equipment according to the wishes of passengers;

Article 53 In violation of the provisions of these regulations, if a vehicle that has not obtained a road transportation certificate or an online car transportation certificate is engaged in taxi operation, the competent transportation department shall order correction and impose a fine of more than 10,000 yuan to 10,000 yuan.
