According to this, the draft of the Black Land Protection Law stipulates that the competent agricultural and rural authorities of the State Council, in conjunction with the relevant departments of the State Council's natural resources, water administration and other relevant departments to comprehensively consider the history and the current status of black land reclamation, as well It is conducive to the principles of comprehensive protection, comprehensive governance, and systematic restoration, scientifically and reasonably determine the scope of black land protection, and adjust it in a timely manner.

According to the provisions of the draft, those in history belong to the black soil, except that it is indeed impossible to repair, in principle, it should be included in the scope of black land protection for protection and restoration. The draft of the Black Land Protection Law also requires that the place where the black land is located should specifically determine the scope of the protection of black land through the black land protection plan and implement the provisions of the detailed laws.
