Protect innovation!Seed method implementation and breeding industry intellectual property protection seminar held

On July 22, the "Seed Law Implementation and Industry Intellectual Property Protection" seminar was held in Beijing. At the meeting, 30 experts and scholars from the judicial, administrative, management, service, and the law and science circles of the law, and the protection system for the protection system of new plant varieties, legal relief, review and testing, variety appraisal, and the protection of intellectual property rights of Hainan Free Trade and Hong Kong industry. Related issues in areas such as applications are discussed in depth.

The meeting was hosted by the Institute of Law of the Chinese Academy of Social Sciences, the Science and Technology Development Center of the Ministry of Agriculture and Rural Affairs, and the Sanya Yazhou Bay Science and Technology City Administration;

The meeting pointed out that the protection system of new plant varieties is an important intellectual property system that stimulates breeding innovation and protects the results of breeding. Strengthening the protection of intellectual property rights in the seed industry is one of the important links to promote the revitalization of the seed industry. Since the implementation of the "Seed Law" in my country in 2000, it has been amended four times in 2004, 2013, 2015, and 2021, and improved the supporting regulations and systems. Rights and interests promote the original innovation of the seed industry. Although the newly revised "Seed Law" last year, although the amendments were not many, it directly involved the major adjustment of the core terms of the protection system of new plant species in my country, providing strong support for the revitalization of the seed industry. With the formal implementation of the new "Seed Law", especially the substantive derived variety system, the amendments to the protection of new plant varieties, the judicial and law enforcement of variety rights, and variety appraisal, conversion and use, etc. will usher in profound changes.

The meeting emphasized the following aspects as soon as possible: First, we must do a good job of publicity and study of the new "Seed Law", deeply understand the spirit of legislative spirit and provisions, and strengthen the awareness of protecting new plant species in the whole society and cracking down on fake and shoddy products. The second is to accelerate the improvement of the regulations on the protection of new plant varieties and the improvement of relevant supporting legal systems and judicial interpretations, and strengthen the technical support of appraisal. For example, the implementation steps and methods of the EDV system, and the amendments to the rules of the guidelines should be put on the agenda. SNP, MNP, SSR and other technologies can be used to use it to achieve effective connection with the Seed Law. The third is to pass the trial of the case, release a group of typical cases, show the determination to govern the seeds in accordance with the law, protect the intellectual property rights of the seed industry in accordance with the law, and strengthen the collection and introduction of international cases to lead the whole society to form a good atmosphere of respect for knowledge and advocate innovation. Finally, after the implementation of the law, the problem of intellectual property protection of breeding materials, breeding intermediates, patents, trademarks, business secrets and new plant rights systems are connected, and the relationship between administrative management and administrative cases and civil case trials.
