Recently, the People's Procuratorate of Kashgar City filed a public prosecution on the crime of producing and selling fake and shoddy products.

In December 2020, the defendant bought a certain food factory to produce three products including "Ziliva Pressive Candy". In April 2021, it was sold to Xinjiang through dealers. In November 2021, the dealer informed the purchase of the three products such as "Ziliwa Pressing the Candy Candy" that was about to expire and unable to sell it normally. More than 180,000 yuan of upcoming products were sent to shopping. Mai Mai, the legal representative of the manufacturer who produced the above food for the business, discussed the re -production.

Mai said that the company's food production license test date was at the end of October 2021. If the purchase date was changed to October 15, 2021, the company could issue a product inspection report according to the above date. So I bought a packaging box that replaced the above products, purchased a manual coding machine, coded the products such as "Ziliva Press the candy", and tampered with the original production date and failure date to October 7, 2021, and 2023. On October 6, the above three products coded were brought to Mai, and Mai issued product inspection reports according to the newly coded date. After getting the report, buy a product that tampering the production date to the dealer sales.

The Kashgar Procuratorate believes that the defendant bought a certain food producer and for profit, to change the product production date, shelf life, and replacement of packaging to produce fake and shoddy products for sales. As a producer, the defendant, Mai, knows that it is still to buy a product of the production date, shelf life, replacement of packaging, and not re -production of its factory. It should be identified as a helping criminal for production and sale of criminals for inferior products, which is a joint crime. The behavior of the two violated the provisions of Article 140 of the Criminal Law of the People's Republic of China. The facts of the crime were clear and the evidence was indeed and sufficient. It should be held criminally responsible for the crime of production and sales of fake and shoddy products.

The People's Court of Kashgar City tried that buying and selling fake and inferior foods by buying the production date and the shelf life of more than 180,000 yuan in the method of tampering with the date of production and shelf life. The imprisonment was one year and 4 months and a fine of 150,000 yuan; the defendant Mai was sentenced to one year in prison and fined 100,000 yuan.

Food operators should establish awareness of the main responsibility of food safety and operate in accordance with laws and regulations. Consumers should brighten their eyes, learn more about food safety related knowledge and relevant laws and regulations. Once they find that food operators are tampering with production date and other behaviors, they will report to the regulatory authorities in a timely manner to jointly create a good food safety environment.
