The intellectual property system has a long history. Compared with developed countries, the protection of intellectual property rights in my country is relatively late, the institutional mechanism is not complete, and there are still problems such as low protection standards, narrow protection scope, and short protection chain. Since entering the 21st century, with the process of marketization of the seed industry in my country, the laws and regulations of the seed industry have been gradually improved. In 2004, the seed method experienced the first revision and modified two provisions related to forest seeds. The second revision of the seed method in 2013 has refined the main body of the seed inspector. The third amendment of the seed method in 2015 added two chapters of the protection and support measures of new varieties. Last year, the seed method was revised for the fourth time, which greatly upgraded the protection of intellectual property rights for the innovation of the seed industry, strengthened the protection of new plant rights in my country, and was basically the highest level of the highest level of international plant varieties.

From a macro perspective, the driving force of the innovation of the national breeding industry comes from the urgent needs of grasping grain autonomy; at the micro level, the key to the independent innovation of the breeding enterprise is the ability and level of the state to protect intellectual property rights.
