On June 24, 2022, the 35th meeting of the Standing Committee of the National People's Congress reviewed and approved the "Black Land Protection Law of the People's Republic of China" and officially implemented on August 1 this year.

This is also the only black land that is protected by dedicated legislation in the four major black soil areas in the world.

Article 29 to 37 of the Black Land Protection Law clearly requires that the competent authority of the natural resource authorities in conjunction with public security, transportation, market supervision and management and other departments of the "full chain" supervision of illegal trading and selling black soil.

At the same time, Article 31 and Article 32 stipulate that if the black land is used for non -agricultural construction, the stolen and digging black soil, and the pollution of black land and the loss of soil and soil, in accordance with the relevant laws and regulations such as land management, pollution prevention, soil and water conservation and other relevant laws and regulations From heavy punishment.

Digging black soil: confiscated income and fined 500 to 1,000 yuan/square fine

Jilin Province is one of the main provinces of the distribution of black land in my country and is located in the central area of ​​black land distribution.

As early as 2018, Jilin Province formulated the "Regulations on the Protection of Black Land in Jilin Province", which is the nation's first black soil protection regulations.

In 2021, Jilin Province also amended the "Black Land Protection Regulations" in Jilin Province, and determined that July 22 was the Jilin Provincial Black Land Protection Day each year.

Article 38 of the revised regulations clearly states that the stolen black soil is prohibited.

At the same time, Article 54 emphasizes that if the provisions of Article 38 of these Regulations, those who steal the black soil shall order the supervision and management department determined by the people's governments at or above the county level to make corrections, confiscate the illegal income, restore the original state within a time limit, and place each cubic cube. Fine fines of 500 yuan to 1,000 yuan; if there is no illegal income, it will be fined 20,000 yuan and 50,000 yuan. Those who have not resumed their original state within the time limit, and the third party that determines the legal qualifications in accordance with the law to carry out the original status activities, and the required expenses shall be borne by illegal actors.
