From September 1, the "Beijing Housing Rental Regulations" was officially implemented. The chaos such as the deduction rent deposit, the individual landlord, and the group rental houses have put forward specific standardized requirements.
The relevant person in charge of the Beijing Municipal Housing and Construction Commission said that in the leasing relationship, the lessee is generally in a relatively weak position. Under the principles of equal protection of the parties in the Civil Code, the regulations further highlight the protection of the live rights and interests of the lessee from the aspects of residence conditions, security guarantees, stable rent, and dispute adjustment.
The regulations stipulate that housing leasing enterprises and real estate brokerage institutions should have corresponding funds, personnel and management capabilities, and require the company's name and business scope to reflect the characteristics of the industry and business, and clarify the requirements of market entity registration and industry filing requirements. The regulations also include "individual two landlords" into supervision, stipulating that individual transfer housing exceeds the prescribed quantity to apply for registration of housing leasing enterprises, and clearly clarify the punishment requirements of illegal acts to provide legal basis for solving this disease.
In addition, the regulations have required fund supervision, stipulating that leasing enterprises shall not exceed one month's rent and must pass the third -party special account custody. The amount of rent shall not exceed three months of rent. Brokerage agencies must not exceed one month's rent, and if the parties renew the contract during the contract period, the brokerage institution shall not collect commissions again.
At the same time, the regulations strictly manage the "rental loan" and stipulate that financial institutions shall issue rental loans based on the lease contract for filing and be included in the lessee account; The frequency shall match the rent frequency with the lessee.
In response to outstanding issues such as group rental housing and disturbing the people, the regulations stipulate that rental housing should be based on the original planned room as the minimum rental unit, and it must not be partitioned to change the internal structure of the house. Non -residential space is not allowed to be rented for residence, and the per capita use area and the number of residents per room must meet the regulations.
